The debate concerning the proper way of understanding, and hence solving, the “is-ought problem” produced two mutually exclusive positions. One position claims that it is entirely impossible to deduce an imperative statement from a set of factual statements. The other position holds a contrary view to the effect that one can naturally derive an imperative statement from a set of factual statements under certain conditions. Although these two positions have opposing views concerning the problem, it should be evident that they (...) both accept that the “is-ought problem” is concerned with the deducibility of imperative statements from factual statements. Later I will argue that this should not be our concern when we try to make sense of the way we reason about morality. (shrink)

At the end of the first hypothesis, Parmenides gets Aristotle to agree that being [οὐσίας] must be in time; that is, that being must partake in at least one of the temporal modes: either to have been in the past, to be in the present, or it will be in the future (140e-142a). If this is true, then “the one does not partake in being” (141e7-8), meaning temporal being—to which Aristotle agrees, saying “Apparently not” (141e9). Parmenides then gets Aristotle to (...) agree that “Therefore, ‘the one’ in no way is” (141e9-10). This, however, contradicts the very first premise that begins Parmenides’ entire gymnastic exercise, “if one is” (137c4). The problem with the previous conclusion—that to be is to be in time—is that in professing his assent to it, Aristotle, in fact, gainsays it. He performatively contradicts the very thing he wants to assert. Aristotle answers Parmenides question, “Therefore could something partake of being in any way other than in one of those ways?” (141e7-8) with a two-word answer in Greek: “οὐκ ἔστιν [It’s not possible].” We can, therefore, ask of the very claim Aristotle is making—that it is impossible for something to be and not be in time—when in time does it hold true? At what time is it “not possible [οὐκ ἔστιν]” for something to not partake of temporal being? Is it not possible only in the present moment, in the past, or in the future? If Aristotle’s assertion is to have any force it must hold always. It has the same tenselessness as mathematical propositions, like ‘1+1=2.’ Forms, like mathematical entities, must necessarily have atemporal existence. Accordingly, in atemporally maintaining that anything that is must be in time, Aristotle undermines his own assertion. He performatively contradicts the very thing that he wants to affirm. (shrink)

In this essay, I propose a reading of two contrasting passions, two kinds of erōs, in the "Symposium." On the one hand, there is the imperialistic desire for conquering and possessing that Alcibiades represents; and on the other hand, there is the productive love of immortal wisdom that Diotima represents. It’s not just what Alcibiades says in the Symposium, but also what he symbolizes. Alcibiades gives a speech in honor of Socrates and of his unrequited love for him, but even (...) here Alcibiades recounts his attempted seduction of Socrates as a failed conquest, as an unsuccessful attempt to violently take possession of something that Socrates has within him. Even more importantly, in 416 BCE (the dramatic date of Agathon’s symposium) Alcibiades was soon to encourage his fellow countrymen to set off on the ruinous Sicilian expedition. Alcibiades’s actions behind-the-scenes of the "Symposium" reveal the clearest manifestation of his imperialistic erōs (for political power in Athens). They also constitute some necessary background to the dialogue, which Plato’s Athenian readers would have had in mind. Where else can we catch a glimpse of this disastrous desire? It is best illustrated in Thucydides’s "History." I show that the beginnings of this political passion can already be seen in Pericles’s funeral oration (2.35-46, specifically 2.43.1) and that after Pericles’s death, Alcibiades stokes this erōs to such a fevered pitch that the Athenians agree to launch the tragic venture against Sicily. Opposed to this political passion, is Diotima’s. She tries to reorient this misguided erōs and presents an alternative form of desire for everlasting wisdom (philosophia). (shrink)

There is another Socratic method, Socratic mimēsis, and an instance of this is when Plato has Socrates play ‘the annoying questioner’ in the Hippias Major. Other interpreters have suggested that the reasons for Socrates’s dramatic play are depersonalization and distance. I argue for viewing Socrates’s role-playing as a way to dramatize the inner dialogue that happens inside one’s mind in what we may call conscience. Hippias the sophist lacks a conscience: his focus is acquisitive as opposed to inquisitive. Plato has (...) staged a pedagogical theater of Hippias’s failed lesson for the benefit of Plato’s audience, the listeners/readers of the dialogue. -/- . (shrink)

This chapter provides an overview of how existential phenomenology has influenced qualitative research methods across a range of disciplines across the social, health, educational, and psychological sciences. It focuses specifically on how the concepts of “existential structures,” or “existentials”—such as selfhood, temporality, spatiality, affectivity, and embodiment—have been used in qualitative research. After providing a brief introduction to what qualitative research is and why philosophers should be interested in it, the chapter provides clear, straightforward examples of how qualitative researchers have used (...) existentials to analyze qualitative data and design qualitative studies. The chapter is intended to introduce philosophers to existential approaches to phenomenological qualitative research, with the aim of facilitating interdisciplinary dialogue and collaboration. In order to fulfil their essential roles as the bearers of truth and the relata of logical relations, propositions must be public and shareable. That requirement has favoured Platonist and other nonmental views of them, despite the well-known problems of Platonism in general. Views that propositions are mental entities have correspondingly fallen out of favour, as they have difficulty in explaining how propositions could have shareable, objective properties. We revive a mentalist view of propositions, inspired by Artificial Intelligence work on (...) perceptual algorithms, which shows how perception causes persistent mental entities with shareable properties that allow them to fulfil the traditional roles of (one core kind of) propositions. The clustering algorithms implemented in perception produce outputs which are (implicit) atomic propositions in different minds. Coordination of them across minds proceeds by game-theoretic processes of communication. The account does not rely on any unexplained notions such as mental content, representation, or correspondence (although those notions are applicable in philosophical analysis of the result). In the "Republic," Plato has Socrates attack poetry’s use of mimēsis, often translated as ‘imitation’ or ‘representation.’ Various scholars (e.g. Blondell 2002; Frank 2018; Halliwell 2009; K. Morgan 2004) have noticed the tension between Socrates’ theory critical of mimēsis and Plato’s literary practice of speaking through various characters in his dialogues. However, none of these scholars have addressed that it is not only Plato the writer who uses mimēsis but also his own character, Socrates. At crucial moments in several dialogues, (...) Socrates takes on a role and speaks as someone else. I call these moments “Socratic mimēsis.” While previous commentators have noticed some of these moments, they have either overstated their rarity or they have not studied them collectively. My dissertation is the first in-depth investigation of this phenomenon in the dialogues. Socrates’ dramatic imitation of others is way of teaching in a voice separate from his own, and it is also a way for Plato to speak to, and to educate, different kinds of audiences. Although “Socratic mimēsis” occurs throughout the Platonic corpus, I focus on three passages from three different dialogues, which are paradigm instances: [1] in the "Crito" Socrates plays the part of ‘the Laws’ (50a-54c); [2] in the "Theaetetus" he acts the part of ‘Protagoras’ (166a-168c); and [3] in the "Menexenus" he recites a funeral speech learned from ‘Aspasia’ (236d-249c). Instead of one-sidedly reading the dialogues as either only literary works of art or as only a series of philosophical arguments, this study gleans philosophic insights from the literary and dramatic details of the dialogues. In chapter one I argue that in the "Crito" Socrates tries to convince Crito of a universal and absolute ethics based on never committing injustice, but Crito is not able to understand. In order to make Crito more just—but not yet at the level of Socratic ethics—Socrates creates ‘the Laws’ to persuade Crito to expand his personal notion of justice. Socrates instills a political obedience in place of Crito’s existing lawlessness as a second-best recourse. Plato expects the astute listener or reader to see the contrast between Socrates’ earlier ethical principles, said in his own voice, with what he says in the voice of ‘the Laws.’ In chapter two I argue that in the part of the "Theaetetus" where Socrates defends Protagoras (often called ‘the Defense’), Socrates, by imitating ‘Protagoras,’ is actually criticizing Protagorean relativism. The Protagorean theory cannot account for mimēsis and Socrates’ mimetic act performatively contradicts the identity of appearance and reality, which the theory presupposes. Finally, in chapter three I argue that in the Menexenus the funeral oration that Socrates recounts for Menexenus that he heard from ‘Aspasia’ is actually a disguised criticism of political rhetoric and of Athenian imperialism. Although the speech is never interrogated within the dialogue, Plato provokes the listener or reader outside the dialogue to question its message and to see how it conflicts with many of Socrates’ positions in other dialogues. Beyond reconsidering the long-standing and persistent view that Plato was against poetry and mimetic performance, I re-examine the role that performance and role-playing can have in philosophy and pedagogy more generally. Actors, by taking on other personas, and audience members, in observing actors and their actions, are both involved in acts of imagination that can expand their horizon of thinking and feeling. This article will contrast two portrayals of Protagoras: one in the "Theaetetus," where Socrates discusses Protagorean theory and even comes to his defense by imitating the deceased sophist; and another in the "Protagoras," where Socrates recounts his encounter with the sophist. I suggest that Plato wants listeners and readers of the dialogues to hear the dissonance between the two portraits and to wonder why Socrates so distorts Protagoras in the "Theaetetus." Protagoras in the "Protagoras" behaves and speaks in ways that (...) are incompatible with the Protagorean position presented in the "Theaetetus.". (shrink)

In this paper, drawing on evidence internal to the Platonic dialogues (supplemented with some ancient testimonia), I answer the question, “How did Plato teach in the Academy?” My reconstruction of Plato’s pedagogy in the Academy is that there was a single person who read the dialogue aloud like a rhapsode (this is in contrast to the dramatic theatrical hypothesis, in which several speakers function as actors in the performance of a dialogue). After the rhapsodic reading, students were allowed to ask (...) that portions of the text to be re-read, to ask a question about the text, and were encouraged to enter into a broader conversation about the topic and themes brought out by the text. This later pedagogical method of interrogating and investigating a dialogue is of more importance than the mere reading of a dialogue. I contend that Plato’s experiences teaching were woven into some of the dialogues, and that Plato’s pedagogy reflects some of the ways that he taught in the Academy. I propose that excellent points made by students may have been written into revised forms of the dialogue. And not only good points, but also mistakes in reasoning may have been added into the dialogues. I suggest that the way certain dialogues are organized with “guest lecturers” and “tag-team” philosophical debates reflect Plato’s pedagogy in the Academy. Plato’s broadmindedness, his openness to various and opposing viewpoints, is also evident from both outside and inside of the dialogue. Lastly, drawing on the idea of Socratic mimēsis, I give a plausible curriculum for how Plato may have used the dialogues to teach them: he had his students “play” with them. Plato may have asked his students to enter into the roles of the characters in the dialogues to better understand them and the type of person they represent. Plato may have also asked students to take over from the position of the character in the dialogue and to suggest a better, truer account of things than what the characters said or did. (shrink)

This article surveys different philosophical theories about the nature of truth. We give much importance to truth; some demand to know it, some fear it, and others would even die for it. But what exactly is truth? What is its nature? Does it even have a nature in the first place? When do we say that some truth-bearers are true? Philosophers offer varying answers to these questions. In this paper I offer an alternative phenomenological account of depression as consisting of a degradation of the degree to which one is situated in and attuned to the world. This account contrasts with recent accounts of depression offered by Matthew Ratcliffe and others. Ratcliffe develops an account in which depression is understood in terms of deep moods, or existential feelings, such as guilt or hopelessness. Such moods are capable of limiting the kinds of significance and meaning that one can (...) come across in the world. I argue that Ratcliffe’s account is unnecessarily constrained, making sense of the experience of depression by appealing only to changes in the mode of human existence. Drawing on Merleau-Ponty’s critique of traditional transcendental phenomenology, I show that many cases of severe psychiatric disorders are best understood as changes in the very structure of human existence, rather than changes in the mode of human existence. Working in this vein, I argue that we can make better sense of many first-person reports of the experience of depression by appealing to a loss or degradation of the degree to which one is situated in and attuned to the world, rather than attempting to make sense of depression as a particular mode of being situated and attuned. Finally, I argue that drawing distinctions between disorders of structure and mode will allow us to improve upon the currently heterogeneous categories of disorder offered in the DSM-5. (shrink)

This paper surveys medieval Christian philosophy.

The relationship between “Towards a Critique of Violence” (1921) and the work of Franz Kafka has been well established by several critical studies devoted to Walter Benjamin. However, it is striking that Benjamin himself, already well acquainted with the work of the Czech writer in 1921, never made any comment to Kafka’s work in this essay, and, more broadly, in any of the related texts that make up the project on the ‘Critique of Violence’. In this article, we analyze a (...) set of notions (Entstellung, Entsühnung, Zurechstellen) that allow us to establish a mediated relationship between this essay and the articles and letters that Benjamin devoted to Kafka in the 1930s. This relationship takes us back to the only piece in which Benjamin carries out an autonomous treatment of the “category of justice” (1916) in which he identifies -as it will happen eighteen years later, in the essay on Kafka (1934)- the locus of justice in the “non-violence”, thus untying the knot that binds in a perhaps indiscernible way in the Jewish tradition the notions of “messianism” and “violence”. La primacía y efectividad del Derecho de la Unión Europea se proyecta también sobre la Administración Pública y sobre sus actos. Esto obliga a la Administración, como sucede con el juez nacional, a aplicar el Derecho europeo de forma efectiva, lo que exige realizar una interpretación conforme del derecho interno y de la práctica administrativa. -/- Sin embargo, a diferencia del juez nacional, la Administración Pública carece de la guía interpretativa del Tribunal de Justicia. Esto hace muy necesario tener en (...) consideración la doctrina de este tribunal sobre la primacía y efectividad del Derecho europeo y su proyección sobre los actos administrativos, donde si bien la seguridad jurídica protege como regla general a los actos administrativos firmes, en algunos casos se deriva una facultad o una obligación de revisión de actos administrativos firmes. -/- El presente trabajo tiene como propósito realizar un análisis actualizado de la jurisprudencia del Tribunal de Justicia sobre la aplicación de la primacía y efectividad del Derecho de la Unión sobre los actos administrativos. El régimen jurídico aplicable a los contratos en el procedimiento concursal se ha visto renovado por la nueva Ley Concursal (LC). En un periodo de crisis económica es importante conocer las condiciones jurídicas de los contratos una vez se ha declarado el concurso de acreedores. -/- Conforme al artículo 21.2 de la LC, dictado el auto de declaración del concurso, los efectos del mismo se producen de inmediato. Y los contratos estipulados previamente por el concursado y que están pendientes, le (...) dotan de derechos u obligaciones frente a otra u otras personas, y es necesario determinar en qué medida afecta la declaración de concurso a estos derechos u obligaciones. -/- En este trabajo tratamos de hacer un esbozo de este régimen jurídico, apuntando las cuestiones que ha planteado la doctrina respecto a problemas de interpretación que ha dejado abiertos la LC. -/- No queremos dejar de señalar que el actual escenario requiere un estudio en profundidad de este régimen jurídico contractual que aborde, no solo los aspectos problemáticos que ha encontrado la doctrina, sino también las soluciones prácticas que han terminado por adoptar los jueces de lo mercantil. Esperemos que pronto se lleve a cabo este estudio jurisprudencial del Derecho contractual concursal, que sin duda será interesante para los concursalistas, y que necesariamente deberá ser abordado con una sólida formación no solo en Derecho mercantil sino también en Derecho civil, lo que refleja la singularidad que comienza a adquirir el Derecho concursal como disciplina jurídica. Esta singularidad es más significativa en lo concerniente al Derecho contractual, pues incluso se introduce en el laberinto del Derecho administrativo como ponemos de manifiesto al tratar el artículo 67 de la LC en este trabajo. Con la entrada en vigor del Tratado de Lisboa, la Carta de Derechos Fundamentales adquiere eficacia jurídica, y se prevé la posibilidad de que la Unión Europea se adhiera al Convenio de Roma. En este trabajo pretendemos acercarnos a los antecedentes que han justificado una huída de la tutela de los derechos fundamentales de base jurisprudencial desarrollada por el Tribunal de Justicia hacia una formalización de la misma, a través de dos caminos: la formalización a través de una declaración de (...) derechos que se ha concretado en la Carta de Derechos Fundamentales, y la adhesión al Convenio de Roma. Finalmente trataremos de esbozar las perspectivas que se abren en el horizonte constitucional de la Unión Europea, donde gozamos ya de un Tribunal de Justicia que ejercerá una función tan constitucional como la tutela de los derechos fundamentales, contenidos ya en una declaración con fuerza jurídica, cuya interpretación se vincula al Convenio de Roma. The application of Artificial Intelligence (AI) in healthcare and epidemiology undoubtedly has many benefits for the population. However, due to its environmental impact, the use of AI can produce social inequalities and long-term environmental damages that may not be thoroughly contemplated. In this paper, we propose to consider the impacts of AI applications in medical care from the One Health paradigm and long-term global health. From health and environmental justice, rather than settling for a short and fleeting green honeymoon between (...) health and sustainability caused by AI, it should aim for a lasting marriage. To this end, we conclude by proposing that, in the upcoming years, it could be valuable and necessary to promote more interconnected health, call for environmental cost transparency, and increase green responsibility. Se ofrece una interpretación de la filosofía política de María Zambrano desde el sufismo deIbnʿArabī. Primero, explicaremos tres nociones centrales en la obra del Šayḫ, como la doble fidelidad a la dimensión de la «incomparabilidad» (tanzīh) y de la «similaridad» (tašbīh), la «nueva creación» (ḫalq al-ǧadīd) y el «hombre perfecto» (insān al-kāmil). Después, trataremos algunos de los textos más políticos de Zambrano, como Horizonte del liberalismo(1929), Isla de Puerto Rico (1940), «Martí, camino de su muerte» (1953) y Persona y democracia (...) (1958). Según veremos, el marco ontológico, epistemológico y antropológicodel maestro andalusí permite ahondar en el sentido místico del discurso político zambraniano. (shrink)

In this chapter, we explain how Karl Jaspers’ concept of empathy can be expanded by drawing upon the tradition of philosophical phenomenology. In the first section, we offer an account of Jaspers' concepts of empathy and incomprehensibility as he develops them in General Psychopathology and “The Phenomenological Approach in Psychopathology.” In the second section, we survey the recent literature on overcoming Jaspers' notion of incomprehensibility and expanding his concept of empathy. In the third section, we outline the levels of investigation (...) at which phenomenological inquiries into psychopathology may proceed. These levels of human existence are, in descending order of depth, (1) phenomenal experiences, (2) interpretive frameworks, (3) modes of existence, and (4) existentials. In the fourth and final section, we argue that to fully empathically comprehend patients with schizophrenia and other mental disorders, the possibility of alterations at all four levels of existence must be acknowledged. La protección de datos constituye un derecho fundamental que, si bien vinculado a la esfera privada de los individuos, goza de entidad propia, y se entiende como un haz de facultades que implican el poder de disposición de los datos, esto es, el derecho a que se solicite el previo consentimiento para su recogida y uso, así como el derecho de acceso, rectificación y cancelación de los mismos. Derecho que en España está basado en el artículo 18.4 de la Constitución (...) Española, y del que deriva la facultad de cancelación al amparo de la Ley Orgánica 15/1999, de Protección de Datos de Carácter Personal. -/- En este trabajo estudiamos si este derecho puede afectar a los Libros de Bautismo de la Iglesia Católica o es más bien la libertad religiosa, que se contempla como derecho o libertad fundamental en el artículo 16 de la Constitución Española, la que debería tenerse en cuenta en relación con los Libros de Bautismo. Debemos considerar que esta libertad podría jugar desde dos perspectivas distintas, o, dicho de otro modo, respecto de dos titulares diferentes: por un lado la Iglesia Católica que considerada como confesión constituye un colectivo de fieles que ostenta la libertad religiosa y tiene derecho a la protección de la misma frente a agresiones externas; pero también la libertad religiosa del individuo, que se concretaría en la posibilidad de pertenecer o no a dicha confesión y en cualquier momento a abandonarla, y las posibles consecuencias de esta decisión en relación con los Libros de Bautismo. Recientemente el Pleno de la Sala de lo Civil del Tribunal Supremo ha venido a resolver, en Sentencia de 18 de junio de 2012 (rec. núm. 489/2007), un recurso de casación en el que se planteaba la cuestión de la eficacia en España, a efectos registrales, de una escritura otorgada ante notario alemán, dándole validez, y, por tanto, estableciendo su aptitud para generar la oportuna inscripción en el Registro de la Propiedad español. -/- Los argumentos fundamentales de la sentencia que (...) comentamos son dos: en primer lugar, la libre prestación de servicios en el ámbito de la Unión Europea excluiría la posibilidad de interpretar que se pueda imponer la intervención en todo caso de un notario español lo que constituiría una restricción de la libertad fundamental antes citada; y en segundo lugar, entendiendo que los efectos de la escritura pública alemana debían regirse por lo previsto en el Derecho español, esto es, los previstos en el artículo 1.462 del Código Civil, y no los previstos en el Derecho alemán, donde se exige un segundo acuerdo de carácter dispositivo para que se produzca la transmisión de la propiedad. Although we can see Consumer Protection primary asan instrument to develop the EU interna! market, it is also a relevant instrument to define the Individual Economic Status of EU citizens and residents as equality players in the EU market. Firstly, we will point out our motivation and objectives of the paper. After that we will explain our methodology, and we (...) will study the EU regulation bases and the concept of consume. La prueba de ADN constituye una herramienta esencial en la investigación criminal, más aún en un contexto de criminalidad globalizada como el que vivimos hoy en día. El objetivo de la utilización de los perfiles de ADN debe ser la obtención de una prueba válida, que goce de eficacia en un proceso penal (en general un proceso nacional), lo que exige que sea lo más fiable posible, y que su obtención respete los derechos fundamentales (y los requisitos legalmente establecidos). Estas (...) notas deben darse en las distintas fases que integran lo que se ha llamado «uso forense de la tecnología del ADN»: obtención de la muestra, extracción del perfil y su tratamiento en la base de datos. El objetivo de este trabajo es aproximarnos a las exigencias derivadas del respeto de los derechos fundamentales en la fase de la obtención de la muestra de ADN, a nivel interno, así como tratar de identificar los problemas existentes en este ámbito teniendo en consideración la participación de nuestro país en el proceso de integración europea. This book offers a philosophical account of memory. Memory is remarkably interesting from a philosophical point of view. Our memories interact with mental states of other types in a characteristic way. They also have some associated feelings that other mental states lack. Our memories are special in terms of their representational capacity too, since we can have memories of objective events, and we can have memories of our own past experiences. Finally, our memories are epistemically special, in that beliefs formed (...) on the basis of our memories are protected from certain errors of misidentification and justified in a way which does not rely on any cognitive capacity other than memory. The aim of the book is to explain these features of memory. It proposes that memories have a particular functional role which involves past perceptual experiences and beliefs about the past and suggests that memories have a particular content as well; they represent themselves as having a certain causal origin. The book then accounts for the feelings associated with our memories as the experience of some of the things that our memories represent; things such as our own past experiences, or the fact the memories originate in those experiences. It also accounts for the special justification for belief afforded by our memories in terms of the content that memories have. The resulting picture is a unified account of several philosophically interesting aspects of memory. (shrink)

Tercer accésit El proceso de integración europea, en el que vivimos inmersos, reviste caracteres económicos, sociales, políticos y jurídicos; que dotan de características peculiares a un proyecto de integración cuya naturaleza está en constante discusión, casi tanto como su futuro. Sin duda, uno de los grandes protagonistas del proceso de integración ha sido y es el Tribunal de Justicia de la Unión Europea, sobre todo con la proclamación y consagración de (...) los principios definitorios de la relación entre el ordenamiento comunitario, hoy de la Unión Europea con los ordenamientos nacionales: los principios de eficacia directa y de primacía del Derecho comunitario. Esto lo ha hecho a la vez que desarrollaba su jurisprudencia sobre las libertades económicas fundamentales consagradas en el Tratado de la Comunidad Económica Europea (libre circulación de mercancías, libre prestación de servicios, libre circulación de trabajadores y libre circulación de capitales). Este trabajo tiene por objeto estudiar dicha jurisprudencia, analizando el papel preponderante de la libre circulación de mercancías, así como las perspectivas de futuro tras la entrada en vigor del Tratado de Lisboa. -/- Abstract. -/- The process of European integration, in which we are immersed, has economic, social, political and legal characters giving special characteristics to an integration project whose nature is in constant discussion as its future. Certainly one of the great protagonists of the integration process has been and is the European Court of Justice, especially with the proclamation and consecration of the defining principles of the relationship between Community law, now European Union law, and national law: principles of direct effect and supremacy of EU law. ECJ recognised this principles while it developed its jurisprudence on fundamental economic freedoms recognised in the Treaty establishing the European Economic Community (free movement of goods, freedom to provide services, free movement of workers and free movement of capitals). This work aims to study this case law, analyzing the dominant role of the free movement of goods as well as the future trends after the entry into force of Lisbon Treaty. (shrink)

The purpose of this chapter is to determine what is to remember something, as opposed to imagining it, perceiving it, or introspecting it. What does it take for a mental state to qualify as remembering, or having a memory of, something? The main issue to be addressed is therefore a metaphysical one. It is the issue of determining which features those mental states which qualify as memories typically enjoy, and those states which do not qualify as such typically lack. In (...) sections 2 and 3, I will discuss the two main existing conceptions of the conditions that a mental state must satisfy to count as an episode of remembering. The first of these approaches is backward-looking. It puts forward conditions that strictly concern the aetiology of the mental state. I will argue that the conditions offered by the backward-looking approach are both too strong and too weak: They rule out mental states which, intuitively, count as memories while including mental states which, intuitively, do not qualify as memories. The second approach is forward-looking. It puts forward conditions that only concern the use that the subject makes of the mental state while forming beliefs about their own life. I will argue that the conditions proposed by the forward-looking approach are both too weak and too strong as well. However, the discussion of the two approaches will allow us to extract some helpful lessons on the constraints that any proposal about the nature of remembering should respect. An alternative approach aimed at incorporating those lessons will be offered in section 4 by drawing on the literature on functionalism. In section 5, I will argue that this approach can, on the one hand, accommodate as memories those mental states which indicate that the backward-looking approach and the forward-looking approach are too strict while, on the other hand, excluding those mental states which suggest that the two alternative approaches are too permissive. Accordingly, I will conclude that construing memory along functionalist lines is a satisfactory approach to the nature of remembering. (shrink)

Gianni Vattimo's Non-religious Christianity. Weakening of being, secularization and divine kenosis.

In this article, we provide three generators of propositional formulae for arbitrary languages, which uniformly sample three different formulae spaces. They take the same three parameters as input, namely, a desired depth, a set of atomics and a set of logical constants (with specified arities). The first generator returns formulae of exactly the given depth, using all or some of the propositional letters. The second does the same but samples up-to the given depth. The third generator outputs formulae with exactly (...) the desired depth and all the atomics in the set. To make the generators uniform (i.e. to make them return every formula in their space with the same probability), we will prove various cardinality results about those spaces. (shrink)

En Argentina, el acusado tiene permitido jurídicamente mentir, en el sentido de que no hay ninguna norma que le prohíba hacerlo. Tradicionalmente se considera que este 'derecho a mentir’ es beneficioso para el acusado. En el trabajo argumento que, por el contrario, le genera un profundo daño epistémico e, indirectamente, moral. Dicho permiso inhabilita que sus afirmaciones puedan ser razones para que sus escuchantes –decisores– crean justificadamente en el contenido de lo afirmado. According to a traditional conception, romantic love is both constant - if someone loves another, they continue to love them - and exclusive - if someone loves another, they love only the other. In this paper, we argue that the essentiality of constancy and exclusivity is incompatible with the possibilities of fission - roughly speaking, of one person becoming two - and fusion - roughly speaking, of two people becoming one. Moreover, if fission or fusion are possible, then constancy and (...) exclusivity are obligatory features of love only if there are moral dilemmas. We conclude by suggesting this casts doubt on the constancy and especially the exclusivity of love. (shrink)

The aim of this paper is to offer a version of the so-called conversational hypothesis of the ontogenetic connection between language and mindreading (Harris 1996, 2005; Van Cleave and Gauker 2010; Hughes et al. 2006). After arguing against a particular way of understanding the hypothesis (the communicative view), I will start from the justificatory view in philosophy of social cognition (Andrews 2012; Hutto 2004; Zawidzki 2013) to make the case for the idea that the primary function of belief and desire (...) attributions is to justify and normalize deviant patterns of behaviour. Following this framework, I elaborate upon the idea that development of folk psychological skills requires the subjects to engage in conversationally mediated joint and cooperative activities in order to acquire the conceptual capacity of ascribing propositional attitudes. After presenting the general version of the hypothesis, I present several testable sub-hypotheses and some psychological studies that give empirical plausibility to the hypothesis. (shrink)

Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

The objective of this paper is to analyze the theistic and atheistic positions regarding the so-called “Problem of Evil”, highlighting their main arguments in an analysis of the solidity of their assumptions, the inferences they draw from them, the biases of these philosophical positions and the inanity of both positions to deduce from them the existence or non-existence of God. I will argue that the difference between both positions, based on the concept of God, is that the atheistic argument is (...) fallacious, while the theistic one is probabilistic but not necessarily accurate. I will end by proposing a different reading of the problem, arguing that both, the atheistic and theistic arguments, lack solidity to demonstrate the existence or non-existence of God based on the problem of evil, and that the question of the problem of evil is vain and sterile for that purpose. In this essay I address the question, “What is the subject matter of phenomenological research?” I argue that in spite of the increasing popularity of phenomenology, the answers to this question have been brief and cursory. As a result, contemporary phenomenologists lack a clear framework within which to articulate the aims and results of their research, and cannot easily engage each other in constructive and critical discourse. Examining the literature on phenomenology’s identity, I show how the question of phenomenology’s subject (...) matter has been systematically neglected. It has been overshadowed by an unending concern with phenomenology’s methodological identity. However, an examination of recent contributions to this literature reveals that a concern with articulating phenomenology’s subject matter has gradually increased, although such articulations remain preliminary. In light of this, I delineate, define, and illustrate three layers of phenomenological research, which I term “existentials,” “modes,” and “prejudices.” While the delineation of these layers is drawn primarily from classical phenomenological texts, they are defined and illustrated through the use of more contemporary literature. Following the articulation of this subject matter, I briefly consider some of the debates—both foundational and applied—that can be facilitated by the adoption of this framework. (shrink)

Empathy is a topic of continuous debate in the nursing literature. Many argue that empathy is indispensable to effective nursing practice. Yet others argue that nurses should rather rely on sympathy, compassion, or consolation. However, a more troubling disagreement underlies these debates: There’s no consensus on how to define empathy. This lack of consensus is the primary obstacle to a constructive debate over the role and import of empathy in nursing practice. The solution to this problem seems obvious: Nurses need (...) to reach a consensus on the meaning and definition of empathy. But this is easier said than done. Concept analyses, for instance, reveal a profound ambiguity and heterogeneity of the concept of empathy across the nursing literature. Since the term “empathy” is used to refer to a range of perceptual, cognitive, emotional, and behavioral phenomena, the presence of a conceptual ambiguity and heterogeneity is hardly surprising. Our proposal is simple. To move forward, we need to return to the basics. We should develop the concept from the ground up. That is, we should begin by identifying and describing the most fundamental form of empathic experience. Once we identify the most fundamental form of empathy, we will be able to distinguish among the more derivative experiences and behaviors that are addressed by the same name and, ideally, determine the place of these phenomena in the field of nursing. The aim of this article is, consequently, to lay the groundwork for a more coherent concept of empathy and thereby for a more fruitful debate over the role of empathy in nursing. In Part 1, we outline the history of the concept of empathy within nursing, explain why nurses are sometimes warry of adapting concepts from other disciplines, and argue that nurses should distinguish between adapting concepts from applied disciplines and from more theoretical disciplines. In Part 2, we show that the distinction between emotional and cognitive empathy—borrowed from theoretical psychology—has been a major factor in nurses’ negative attitudes toward emotional empathy. We argue, however, that both concepts fail to capture the most fundamental form of empathy. In Part 3, we draw on and present some of the seminal studies of empathy that can be found in the work of phenomenological philosophers including Max Scheler, Edmund Husserl, and Edith Stein. In Part 4, we outline how their understanding of empathy may facilitate current debates about empathy’s role in nursing. (shrink)

In his work Why I Am Not a Christian and Other Essays on Religion and Related Subjects, Bertrand Russell attempts to demonstrate the nonexistence of God. In this work we will address the analysis of the consistency of his arguments on the existence of God and the First Cause, using the AV (Acceptability-Inferential Validity) scheme in a philosophical-argumentative study of them, to reveal their weaknesses, and we will propose a more solid type of argumentation and its corresponding counterargument.

Este artículo explora la relación entre la filosofía del límite de Eugenio Trías y el sufismo de Ibn ʿArabī. En primer lugar, pretende explicar la función de la filosofía de la religión en el sistema triasiano y por qué el maestro andalusí ocupa un lugar privilegiado en ella. Segundo, se ocupa de algunos aspectos esenciales de la doctrina akbarí que la filosofía del límite obtura, como la declaración de la unidad del Ser (tawḥīd), la conjugación de lo exotérico y lo (...) esotérico, la superación de la propia creencia, el camino de la servidumbre (ʿubūdiyya), el tránsito de la pasión súbita de amor (hawā) al amor espiritual (ḥubb), la caballería espiritual (futuwwa) y la morada de la no-morada (maqām lā maqām), los cuales comparten un nexo común: el trascendimiento de lo egoico y el interés en el otro en tanto otro. Finalmente, se defenderá que la obturación triasiana se debe tanto al influjo de Henry Corbin, como sobre todo, a las propias limitaciones de su proyecto filosófico, para el que el Ibn ʿArabī ausente constituye una suerte de sombra. Contemporary psychiatry finds itself in the midst of a crisis of classification. The developments begun in the 1980s—with the third edition of the Diagnostic and Statistical Manual of Mental Disorders —successfully increased inter-rater reliability. However, these developments have done little to increase the predictive validity of our categories of disorder. A diagnosis based on DSM categories and criteria often fails to accurately anticipate course of illness or treatment response. In addition, there is little evidence that the DSM categories link up (...) with genetic findings, and even less evidence that they... (shrink)

In the present work, we propose to analyse the category of consumer and how this individual status is being conditioned by European Union (EU) law. After a brief reference to the methodology used, the analysis begins with a consideration about the foundations of consumer protection in EU law and how it developed from an instrument to develop the EU internal market to a relevant one to define the EuroStatus of EU citizens and residents as consumers and players in the market (...) under modern EU law. We will consider consumer protection configuration, the notion of consumer, and the development of a consumer legal framework in the EU, with references to national legislation that can reinforce consumer status. We also consider the European Court of Justice (ECJ) case law, not only regarding its important role in the definition of the notion of a consumer but also in the development of a consumer constitutional procedural for EuroStatus, consolidating the consumer position in the national judicial process. This chapter provides an overview of how existential phenomenology has influenced qualitative research methods across a range of disciplines across the social, health, educational, and psychological sciences. It focuses specifically on how the concepts of “existential structures,” or “existentials”—such as selfhood, temporality, spatiality, affectivity, and embodiment—have been used in qualitative research. After providing a brief introduction to what qualitative research is and why philosophers should be interested in it, the chapter provides clear, straightforward examples of how qualitative researchers have used (...) existentials to analyze qualitative data and design qualitative studies. The chapter is intended to introduce philosophers to existential approaches to phenomenological qualitative research, with the aim of facilitating interdisciplinary dialogue and collaboration. ecientemente hemos podido asistir a una revitalización del debate sobre la primacía del Derecho de la Unión Europea y los eventuales límites de la misma que algunos tribunales constitucionales defienden para preservar la identidad constitucional y otros principios esenciales del orden jurídico interno. -/- El Tribunal Constitucional Federal alemán ha declarado, en sentencia de 5 de mayo de 2020, que la sentencia Weiss y otros del Tribunal de Justicia de la UE es ultra vires. La reacción mayoritaria institucional y doctrinal (...) ha sido la de cuestionar la decisión del Tribunal alemán, así como el pluralismo constitucional que entienden está detrás de la misma. -/- Este trabajo, desde una perspectiva abierta y plural, trata de aproximarse al debate constitucional, identificar algunos de los problemas existentes en el orden jurídico multinivel europeo, y defender que, no siendo las cosas fáciles, se hace más necesario que nunca huir de posiciones absolutas y buscar el diálogo entre tribunales. En diversas ocasiones se han producido tensiones entre el Tribunal Constitucional y el Tribunal Supremo, que han trascendido a la opinión pública y que han sido motivo de debates, tanto en la doctrina como en la arena política. -/- Estas tensiones se agudizaron con ocasión de la famosa condena por responsabilidad civil de los Magistrados del Tribunal Constitucional por parte de la Sala Primera del Tribunal Supremo; y que ha sido causa de que el legislador haya introducido en la reforma (...) de la Ley Orgánica del Tribunal Constitucional una serie de medidas tendentes a fortalecer la posición institucional del máximo intérprete de la Constitución. -/- En este trabajo tratamos de acercarnos a estas tensiones, tanto cuando interviene la Sala Primera del Tribunal Supremo, como cuando interviene la Sala Segunda y la relevancia que tiene cada episodio. -/- A esta situación, se une la fuerza jurídica con la que se acaba de dotar al Tribunal Constitucional con motivo de la reciente reforma de su ley orgánica. El Tribunal Constitucional dispone ahora del instrumento del artículo 4 de la Ley Orgánica del Tribunal Constitucional, que pretende garantizar la fuerza vinculante de su jurisprudencia que ya se desprendía de la Constitución y su ley orgánica. -/- Es necesario estudiar si esta reforma va a ser o no suficiente para garantizar de forma definitiva la supremacía del Tribunal Constitucional en nuestro sistema jurídico-constitucional; y en qué medida esta reforma afecta al equilibrio institucional existente. -/- También se reflexiona, en último lugar, sobre la conveniencia de una articulación distinta del sistema de responsabilidad de los Magistrados constitucionales, que, sin restarles independencia, les dote de una mayor legitimidad en el ejercicio de su función.
